Terms and Conditions

1. Scope

These Terms and Conditions apply to all services provided by Carina Puk in the areas of web design, web development, and related consulting and support services.

Any deviating agreements require written form.

2. Offer and Contract

Offers are non-binding unless expressly stated otherwise.

A contract is concluded as soon as an offer is accepted in writing (e.g. by email) or a service is expressly commissioned.

3. Scope of Services

The scope of services is determined by the respective offer or individual agreement.

Services not expressly agreed upon are not part of the contract.

4. Client Obligations

The client provides all content, information, images, logos and access data required for the project in a timely manner.

Delays due to missing or late provision of information will extend agreed deadlines accordingly.

The client confirms that they hold the necessary usage rights to all provided content.

5. Remuneration

The prices agreed in the offer apply.

Invoices are payable within 14 days without deduction unless otherwise agreed.

Not included in the offer price are costs for domain, hosting, paid fonts, stock photos, licenses, third-party software or external services (e.g. Calendly, email services, CMS plugins), unless expressly listed in the offer.

6. Revisions

Unless otherwise agreed in the offer, up to two rounds of revisions are included in the agreed price.

Additional change requests or subsequent extensions will be charged based on time and effort.

7. Acceptance

Upon completion, the client has the opportunity to review the agreed services.

If no feedback is received within ten calendar days or the website is put into productive use, the services are deemed accepted.

8. Usage Rights

Usage rights to the created work results transfer to the client upon full payment, unless otherwise agreed.

Content licensed from third parties (e.g. fonts, images, icons or software) is subject to the respective license terms.

9. Reference

Carina Puk is entitled to use completed projects as references for self-promotion and to name the client, unless the client expressly objects.

10. Liability

Carina Puk is liable for damages caused intentionally or through gross negligence in accordance with legal provisions.

Liability for lost profits, indirect damages or data loss is excluded to the extent permitted by law.

The client bears sole responsibility for content provided by them.

11. Maintenance and Support

After project completion, there is no entitlement to free maintenance or support unless a separate maintenance agreement has been concluded.

12. Data Protection

Personal data is processed in accordance with the privacy policy and applicable data protection laws.

13. Use of AI Tools

AI-assisted tools may be used to support conception, design, development or content creation. The results are reviewed before delivery and revised if necessary. The client receives the agreed service regardless of which tools were used in the creation process.

14. Final Provisions

Swiss law applies.

Should individual provisions of these terms be or become invalid, the validity of the remaining provisions shall not be affected.
